Welcome to Royal Yachts Miami. By using our services, you agree to the terms and conditions outlined below. Please read them carefully before making a booking.
Royal Yachts Miami L.L.C. ("BROKER") acts solely as an intermediary between the CHARTERER and the yacht OWNER. The BROKER does not own, manage, control, or operate any of the yachts listed or chartered through its platform. All charter services, including but not limited to vessel operation, crew performance, safety, and equipment condition, are the sole responsibility of the OWNER and/or their representatives.
By booking a charter, the CHARTERER acknowledges and agrees that:● The BROKER shall not be held liable for any injuries, damages, losses, delays, cancellations, or dissatisfaction arising from the charter experience.● Any claims related to service quality, performance, or damages must be addressed directly with the OWNER.● The BROKER is not responsible for the accuracy of vessel specifications or representations made by the OWNER.
1. Definitions● OWNER: The legal owner or representative of the yacht.● CHARTERER: The individual or entity booking the charter.● BROKER: Royal Yachts Miami, a third-party intermediary that facilitates bookings between the CHARTERER and the OWNER. The BROKER does not own or operate any vessels and assumes no liability for charter operations.
2. Bookings and Payments
Booking ConfirmationBookings are confirmed only after receiving the agreed deposit (typically 50%) or full payment. All bookings are subject to availability and confirmation.
Payment MethodsWe accept payments via credit/debit card (Visa, MasterCard, American Express), wire transfer, Zelle, CashApp, Venmo, PayPal, or cryptocurrency (on request). Card payments may be subject to a 3.5% processing fee.
Required InformationTo complete your booking, we require your full name, contact details, number of guests, date/time of charter, and any special requests.
While we strive to provide the exact yacht booked, Royal Yachts Miami reserves the right to substitute a comparable yacht of similar size, class, and amenities if the original vessel becomes unavailable. Substitutions will only be made when necessary, and shall not constitute grounds for refund or cancellation unless the replacement vessel is materially inferior.
3. Cancellation and Refund Policy
Cancellation by Charterer● The deposit (typically 50%) is strictly non-refundable.● If cancellation occurs more than 14 days prior to the charter, any amount paid beyond the deposit may be refundable, minus actual incurred costs (e.g., decorations, provisioning).● If cancellation occurs within 14 days, all payments are non-refundable.● Rescheduling is possible but not guaranteed, and subject to availability and rate changes.● Even if the yacht is rebooked, refunds are not obligatory and remain solely at the OWNER’s discretion.
No-Show PolicyFailure to arrive at the scheduled time without prior notice will be considered a no-show. In such cases, all payments will be forfeited, and the charter will be canceled without rescheduling.
Cancellation by OwnerIf canceled by the OWNER:● Due to force majeure (e.g., named storms, mechanical failure), the CHARTERER will receive either a full refund or rescheduling.
4. Weather & Force Majeure● If the U.S. Coast Guard or the Captain deems it unsafe to sail (e.g., storm, high winds), a full refund or rescheduling will be offered.● Light rain or cloud cover does not qualify for cancellation or refund.● Final decision rests with the Captain’s professional judgment.
5. Usage of the Yacht
Maximum GuestsGuest numbers may not exceed the licensed maximum. Exceeding capacity may result in immediate termination of the charter without refund.
Behavior and ConductGuests must act respectfully toward the crew and fellow guests. The Captain may terminate the trip without refund in case of:● Misconduct● Intoxication● Unsafe behavior● Verbal or physical harassment
Children and SupervisionChildren are welcome but must be supervised at all times by responsible adults.
Drugs, Alcohol, and SmokingIllegal substances and weapons are strictly prohibited. Smoking is only allowed in designated exterior areas. Alcohol is permitted for adults aged 21+.
6. Payments for Add-On ServicesAll third-party services (e.g., chef, DJ, decorator, bartender, jet ski) must be paid in full at time of reservation. These payments are non-refundable, as vendors incur substantial preparation costs and block their availability.
7. Safety Guidelines● Follow all instructions from the Captain and crew.● Life jackets and safety equipment are provided and must be used when required.● The crew may restrict use of water toys if deemed unsafe.
8. Damage and Liability
Guest ResponsibilityGuests are financially responsible for any damage to the yacht or its equipment caused by negligence or misconduct.
Lost ItemsRoyal Yachts Miami and the OWNER are not liable for lost, stolen, or forgotten items onboard.
InsuranceThe yacht is covered under OWNER’s insurance. CHARTERERS are encouraged to carry personal travel, health, and liability insurance.
9. Operating CostsThe Charter Fee includes the yacht, crew, basic equipment, fuel (standard routes), and standard onboard supplies unless otherwise stated.
10. Breakdown or DelayIf the yacht becomes unusable due to OWNER-related issues:● If the issue prevents the charter from taking place entirely on the scheduled date, the CHARTERER will receive either a full refund or the option to reschedule, subject to availability.● If the charter is moved to a different time on the same day but the total duration remains the same, this does not qualify for a refund. Rescheduling or small compensation (e.g., extra charter time or amenities) may be offered at the OWNER’s discretion, subject to availability.● If the issue causes the charter to be shortened, a partial refund will be issued pro rata based on lost time.● If the issue arises mid-charter, refund eligibility will be determined proportionally based on time remaining.
If unusable due to CHARTERER's actions (e.g., late arrival, overcapacity), no refund or rescheduling will be granted.
11. Privacy & ConfidentialityYour personal data is handled in accordance with our Privacy Policy. The OWNER and crew will keep guest information confidential, unless legally required to disclose it.
12. Promotional Offers● Promotional codes or discounts must be applied at time of booking.● Offers cannot be combined unless explicitly stated.
13. Media Release Royal Yachts Miami may take photos or videos during your charter for promotional use. If you wish to opt out, please notify us in writing prior to your trip.
14. Complaints If any issues arise during your charter, notify the Captain immediately. If the issue is not resolved onboard, the CHARTERER must contact Royal Yachts Miami in writing within 24 hours of the charter’s end.
However, to preserve your right to any dispute, refund, or compensation, issues involving vessel condition, cleanliness, or functionality must be reported before the vessel departs the marina. Supporting photo or video evidence may be requested.
Failure to report such issues prior to departure may waive your right to dispute the matter after the charter concludes. Late submissions may not be eligible for investigation or compensation.
15. Chargebacks and Payment DisputesBy making a booking, the CHARTERER agrees not to initiate a chargeback without first attempting to resolve the issue directly with Royal Yachts Miami.
Unjustified chargebacks may be treated as fraud and pursued through legal means.
16. Governing Law and Dispute ResolutionThis agreement is governed by the laws of Florida, USA.Any dispute shall be resolved via binding arbitration under the Miami International Arbitration Society (MIAS).

17. Indemnification The CHARTERER agrees to indemnify, defend, and hold harmless Royal Yachts Miami L.L.C., its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from or related to:  
● Any damage to the yacht, equipment, marina, or third-party property caused by the CHARTERER or their guests.  ● Any injury or harm to persons during the charter resulting from CHARTERER’s or guests’ actions or negligence.  ● Any violation of these Terms or applicable laws by the CHARTERER or their guests.  ● Any claims brought by third parties as a result of the CHARTERER’s conduct during the charter.
18. Assumption of Risk The CHARTERER acknowledges that participating in a yacht charter involves inherent risks, including but not limited to: physical injury, drowning, equipment failure, changing weather conditions, and other unforeseen hazards. By booking and boarding the yacht, the CHARTERER voluntarily assumes all such risks on behalf of themselves and their guests.  Royal Yachts Miami L.L.C. shall not be liable for any injury, loss, or damage resulting from such risks.
19. Changes to TermsWe may update these Terms of Service at any time. All updates will be posted at www.royalyachtsmiami.com/terms-of-service. Continued use of our services implies agreement to the latest version.
